Terms of Service

These Terms of Service ("Terms") govern your access to and use of FlowAlert (the "Service"), which is provided by Create Swift Co., Ltd.("FlowAlert", "we", "us"), a company registered in Thailand under registration number 0205568034531, with its registered office at 238/6 Moo 6, Nong Prue Subdistrict, Bang Lamung District, Chonburi 20150, Thailand. By creating an account or using the Service, you agree to these Terms.

The service

FlowAlert routes operational events to people via push notifications, with routing rules, on-call schedules, acknowledgement, and escalation. We may add, change, or remove features over time.

The FlowAlert mobile application is published on the Apple App Store and Google Play by Alertstream Ltd, a company registered in England and Wales (company number 17252266, registered office: 128 City Road, London, EC1V 2NX, United Kingdom), an affiliate of Create Swift Co., Ltd. acting solely as app publisher. Your contract for the Service, including all payments, is with Create Swift Co., Ltd.

Accounts

You are responsible for your account, for keeping your credentials secure, and for activity under your account. You must provide accurate information and be old enough to form a binding contract.

Acceptable use

• Don't use the Service for unlawful, harmful, or abusive purposes.
• Don't send content you have no right to send, or use the Service to spam or harass.
• Don't attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

Plans & billing

Paid plans are billed through Stripe on a recurring basis until cancelled. Fees are non-refundable except where required by law. Plan limits (such as monthly events and number of subscribers) apply as described in the app. We may change pricing with notice.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that every notification will be delivered, delivered on time, delivered only once, or delivered at all. FlowAlert is provided on a best-effort basis with no uptime or delivery service-level agreement (SLA) unless one is agreed with you in a separate signed contract.

Delivery depends on third parties and conditions outside our control — including Apple Push Notification service (APNs), Firebase Cloud Messaging (FCM), your upstream event sources, and the recipient's device, operating system, app settings, and network connectivity. Do not rely on FlowAlert as the sole channel for life-safety, medical, financial, or emergency alerting.

Limitation of liability

To the maximum extent permitted by law, FlowAlert will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. This includes, without limitation, any loss or damage arising from missed, delayed, duplicated, misrouted, or undelivered notifications, or from any failure or interruption of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Governing law

These Terms are governed by the laws of Thailand, and the courts of Thailand have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory local consumer law provides otherwise.

Changes

We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms.
